  • "User" refers to anyone who uses our services, including browsing our website.

  • "AI Agents" refers to artificial intelligence systems used by Webera to assist in service delivery.

Introduction

These Terms of Service govern your use of the website at https://webera.com, our DevOps On-Demand service, and any other related services that Webera provides. By accessing our website or using any of our services, you agree to be bound by these terms. For the specific terms governing the DevOps On-Demand service, please refer to our DevOps On-Demand Subscription Agreement.

Acceptable Use

You agree not to:

  • Copy, distribute, modify, or reverse engineer any content without permission
  • Remove or alter any copyright or proprietary notices
  • Transfer, mirror, or reuse any content without permission
  • Disrupt, overwhelm, or abuse Webera's services or networks
  • Transmit harassing, obscene, fraudulent, or illegal material
  • Violate any applicable laws, regulations, or these Terms of Service
  • Infringe on the rights of Webera or any third-party

Intellectual Property

Our website's content, trademarks, logos, and other intellectual property are owned by Webera and protected by copyright and trademark laws. Users are granted a limited license for personal use only. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service. The ownership of work products created as part of the DevOps On-Demand service is governed by the terms of the DevOps On-Demand Subscription Agreement.

DevOps On-Demand Materials

The code and materials created for you as part of our DevOps On-Demand service belong solely to you upon full payment and are subject to the terms of the DevOps On-Demand Subscription Agreement.

AI-Assisted Creation: Materials may be generated with the assistance of artificial intelligence tools and agents, with human engineering oversight and review applied to all deliverables. All AI Agent outputs are reviewed by Webera's engineers before delivery to you.

Provider Retained Rights: Webera retains the right to use anonymized patterns, templates, and methodologies derived from service delivery to improve its services and AI agents, provided no Customer-identifiable information is disclosed.

Confidentiality and Showcase Rights

All Customer infrastructure, configurations, and deliverables created through DevOps On-Demand services are confidential by default. Webera will not publicly disclose, showcase, or reference your infrastructure or use of services without your prior written consent.

You may opt-in to:

  • Anonymous case studies (no identifying information)
  • Named case studies (with your review and approval)
  • Logo usage on Webera's website

Opt-in requests will be made separately and do not affect service delivery.

User Content

You'll keep ownership of any content you send but give Webera a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to display, distribute, and reproduce it in connection with the services. You can terminate this license at any time by deleting your content.

Privacy

Your privacy is important to us. Our Privacy Policy governs the use and handling of your data.

Billing and Payment

The DevOps On-Demand Subscription Agreement details the billing and payment terms for the DevOps On-Demand service. The specific billing and payment terms for other services will be provided at the time of purchase.

Termination

Either party may terminate the DevOps On-Demand service by the termination provisions of the Subscription Agreement. Webera reserves the right to terminate access to the website and other services at any time for violations of these Terms of Service.

Confidentiality

Webera will handle confidential information by the confidentiality provisions of the Subscription Agreement and our Privacy Policy.

Disclaimers

The website and services are provided on an "as is" basis without any warranties. Webera disclaims any implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of Liability

Webera shall not be liable for any damages arising from using the website or services, including direct, indirect, incidental, punitive, or consequential damages. Further limitations may apply to the DevOps On-Demand service as set out in the Subscription Agreement.

Indemnification

You agree to fully indemnify and hold harmless Webera from any claims, damages, or expenses from your website or services.

Governing Law

The laws of the Commonwealth of Virginia, USA shall govern these Terms of Service. Any disputes will be subject to the jurisdiction of the courts in Virginia.

Electronic Communications

You consent to receive electronic communications from Webera and agree that all agreements, notices, and other legally required communications may be provided electronically.

Changes to Terms

Webera reserves the right to amend these Terms of Service at any time. Your continued use after posting changes means you've accepted the revised terms.
